What do attorneys do when they have a potential client with questionable capacity and no representative? California laws address legal capacity and decision making in a piecemeal fashion. As a result, decision making for people who lack capacity and a legal representative is erratic and often illegal. This webinar will review the merits of various options for assisting clients with no capacity and no representative, focusing primarily on the determination of capacity and financial and health care decision-making. We will also carefully examine social and government resources that may be available to help. Finally, we will assess an attorney's ethical obligations in representing clients with questionable capacity. This webinar will include ½ hour of Ethics MCLE.
