Draft Proposed Trust Fund Program Rule Change Expected to be Released for Comment on Friday

The Stakeholders Committee of the State Bar Board of Governors (BOG) is expected to release a draft of proposed changes to the IOLTA regulations regarding applications, eligibility, monitoring, and complaints/appeals this Friday. If the BOG agrees to the recommended 45 days of public comment scheduled, comments on the proposed changes will be due by June 30th.
LAAC is working on a red-lined version of the proposed new rules, identifying where they vary from the IOLTA statute and current rules. We plan to release this to programs on June 3rd. LAAC will also submit comments on the proposed rule and we will send a draft of these comments around to programs by June 20th. Programs will be asked to submit their own comments, as well, and LAAC staff will be available to answer questions as needed after LAAC circulates its draft comments.
